CERTIFICATE OF PATENT (LETTERS PATENT)

The Certificate of Patent, or Letters Patent, is a legal document issued by a government patent office under the Patent and Design Act of 2023. It grants exclusive rights to inventors for new inventions, outlining conditions, rights conferred, duration of protection, enforcement procedures, and other related provisions. This document serves to officially recognize and protect an inventor’s intellectual property rights.

Step by step process

Step 1 Application form collection & submission: Collect the application form from the office or website and customize it as required. Fill in Form 1 and 1A for local applications or Form 2 and 2A for foreign applications. Deposit the fees through Treasury Challan or in any commercial bank via Bank Draft/Pay Order. Submit the application at the Receiving Section with all required documents.

Step 2: Verification and File Opening: Deputy Registrar and Assistant Registrar verify documents initially. Patents Section staff further verify and open a file for the application, forwarding it to the Registrar for processing.

Step 3 Patent Application Examination: Following file opening, the patent application undergoes substantive examination by designated Examiners. This examination process ensures that the application complies with all legal and technical requirements for patentability. The examination is carried out diligently to evaluate the novelty, inventive step, and industrial applicability of the invention described in the application. Once examined, the application is processed through appropriate channels for further review and decision-making.

Step 4 Examination and Reporting: The Registrar sends the application for notification in the BG Press and examination by the Examiner of Patents. The Examiner prepares a comprehensive report on findings and recommendations, forwarding it through AR, DR, and Registrar.

Step 5 Approval and Issuance of Acceptance Notice: Upon review of the examination report, the Registrar approves the application and returns it via AR, DR, and Examiner. The Examiner issues an acceptance notice to the applicant, directing further actions.

Step 6 Final Steps for Patent Issuance: Applicants submit the sealing fee and receive a money receipt. The receipt is submitted at the Dispatch Section. Approximately four months after Gazette publication, the Registrar issues the Certificate of Patent (Letters Patent), formalizing patent rights.

Deposited by Treasury Challan at Bangladesh Bank or designated branches of Sonali Bank or Pay Order through any commercial bank.

Step by step process

Step 1 Application and Payment Submission: Begin by writing an application requesting Certificate renewal, ensuring all required details and documents are included. Simultaneously, deposit the renewal fees through a Treasury Challan or by issuing a Pay Order/Bank Draft drawn in favor of the issuing authority. Submit the completed application along with the original Bank Draft/Pay Order to the Renewal Section of DPD&T or the relevant authority overseeing Certificate renewals.

Step 2 Approval and Completion: The Deputy Registrar reviews and approves the application for renewal. Upon approval, the renewal process concludes, and you receive the renewed Certificate with updated validity.
